What Is Municipal Law?

Municipal law encompasses numerous topics and issues related to town, village, and city governments, such as municipal governance, land use, zoning and comprehensive planning, drafting and amending local laws, compliance with laws, and litigation.

We can help you with:

General Municipal Law

Our firm serves as general counsel for municipalities on a wide rage of matters related to the day-to-day operation and management of local governments. Our attorneys advise municipalities with respect to governance responsibilities, meeting process and procedure, drafting resolutions and local laws, New York Town, Village and City law requirements, compliance with the Open Meetings Law, Freedom of Information Law and General Municipal Law, local code enforcement, real estate matters and eminent domain, procurements requirements, and municipal contracts and ethics.

Land Use and Zoning

Our firm represents local planning, zoning, and historic preservation boards in all aspects of land use planning and applications, including area and use variances, site plans, subdivisions, planned unit developments, rezoning, overlay district formation, incentive zoning, and special use permits.  Our attorneys provide comprehensive guidance in complying with the New York State Environmental Quality Review Act (SEQRA), from preparation of environmental assessment forms to issuance of negative and positive declarations, or preparation of scoping statements, draft and final environmental impact statements, and findings statements.  Our firm also has experience in renewable energy and siting issues facing municipalities, including drafting local laws concerning large scale solar energy systems and advising boards on solar development.

Labor and Employment

Our firm advises municipal and local government entities on a wide range of labor, employment, and discrimination matters, including compliance with state and federal employment laws, development of employee policies and handbooks, and discipline and discharge.  Our firm’s attorneys represent officers and government entities before state and federal agencies, as well as in state and federal courts.

Municipal Litigation

Our firm has extensive experience in representing governmental boards and officials in civil actions and CPLR Article 78 proceedings in New York state trial and appellate courts.  We also serve as special litigation counsel for municipalities in connection with municipal, environmental, land use, and zoning matters arising out of local zoning laws and municipal board review.  We have successfully defended town boards, planning boards, and zoning boards on a wide range of land use and zoning cases from the initial filing of the complaint through trial and appeals to uphold decisions made by local boards for the benefit of their communities.
